Terms & Conditions Of AI surveillance
Welcome to AI Surveillance. These Terms and Conditions ("Terms") govern your purchase and use of the services, software, and hardware provided by AI Surveillance ("Company," "we," "us," or "our"). By enrolling in our services or installing our software, you ("Client," "you," or "your") agree to be bound by these Terms.
1. Description of Services
AI Surveillance provides a Video Management System (VMS) with integrated Artificial Intelligence (AI), human-verified monitoring via our global operations centers, and Point of Sale (POS) forensic auditing. Services may include:
- Real-time AI alerts (loitering, perimeter breach).
- Human-in-the-loop monitoring and two-way audio "voice-down" deterrence.
- POS data analysis (including tracking aborted transactions, safe drops, and coupon ring-ups under $0.75).
- Environmental sensor monitoring (coolers, HVAC, panic buttons).
2. Client Responsibilities
To ensure the effectiveness of the system, the Client agrees to:
- Connectivity: Maintain a stable, high-speed internet connection and consistent power supply at the protected site. We are not responsible for service interruptions caused by your ISP or local power failures.
- Hardware Maintenance: Ensure all cameras and sensors are clean, unobstructed, and in good working order.
- Access: Grant AI Surveillance necessary remote access to VMS and POS systems to perform forensic auditing and live monitoring.
3. Intellectual Property
All software, AI models, algorithms, dashboard interfaces, and "Work for Hire" created by our developers (including custom POS logic) are the sole and exclusive property of AI Surveillance.
- You are granted a non-exclusive, non-transferable license to use the software during your active subscription period.
- You may not copy, reverse-engineer, or redistribute our proprietary code or logic to any third party.
4. Limitation of Liability & "No Guarantee" Clause
AI Surveillance is a deterrent, not a guarantee of safety or zero loss.
- Not an Insurer: We are not an insurance company. Our fees are based on the value of the monitoring service, not the value of the property on your premises. You are responsible for maintaining adequate insurance coverage for your business.
- Liability Cap: To the maximum extent permitted by law, AI Surveillance’s liability for any claim (whether in contract or tort) shall not exceed the total amount paid by the Client for the service during the six (6) months preceding the event giving rise to the claim.
- Third-Party Acts: We are not liable for the criminal acts of third parties, the failure of local law enforcement to respond to alerts, or losses due to employee theft that occurs outside the scope of flagged POS events.
5. Subscription, Fees, and Cancellation
- Billing: Services are billed monthly in advance.
- Cancellation: Unless otherwise specified in your specific Service Agreement, you may cancel your service with 30 days' written notice.
- Non-Payment: We reserve the right to suspend live monitoring and AI services if accounts remain unpaid for more than 15 days past the due date.
6. Privacy and Data Usage
Your use of the services is also governed by our Privacy Policy. You acknowledge that live feeds and POS data will be accessed by our authorized monitoring team in India for the purpose of providing the service. You are responsible for notifying your employees and customers of the presence of surveillance and audio recording in accordance with local laws.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws. Any legal actions arising from these Terms shall be filed in the courts of the county where AI Surveillance is headquartered.
